⚖️ Constitutional & Nepal Government Legal Framework
Awareness begins with knowing the law. Regent Residential School fully aligns its child safety protocols with the supreme legal frameworks of Nepal. All staff are subjected directly to these laws without exception:

Part 3, Fundamental Rights & Duties - Article 39: Rights of the Child
- Article 39, Section 4: No child shall be employed in factories, mines, or engaged in any other hazardous work. (Prohibition of child exploitation).
- Article 39, Section 6: No child shall be subjected to physical, mental, or any other form of torture in home, school or other place and situation whatsoever.

1. Zero Tolerance: Corporal & Physical Punishment
Regent Residential School enforces an absolute ban on corporal punishment. There is no pedagogy, situation, or student provocation that justifies physical handling, intimidation, or striking.

3. Zero Tolerance: Sexual Abuse, Exploitation & Harassment
Any form of sexual misconduct, advance, inappropriate text/digital interaction, grooming, or physical proximity violation is a direct criminal offense.
Critical Incident Emergency Protocol
In case of any suspect behavior, allegation, or observed indicators of physical/verbal/sexual abuse, the school acts immediately:
- Immediate Suspension: The school instantly suspends the accused individual without prior notice or pay, preventing any access to campus or students.
- Police & Government Intervention: The school immediately reports the case to the Nepal Police, child protection authorities, and local government child protection units.
- Active Prosecution: The school supports the investigation to its maximum capability, turning over logs, records, and relevant materials.
- Victim Support Structure: Continuous mental health counseling, trauma support, and legal guidance are provided to the victim and their family.
4. Proper and Professional Communication with Parents
Safeguarding requires complete, transparent coordination with guardians. Keeping parents uninformed about critical behavioral, academic, or physical safety incidents on campus is a serious procedural violation.

⚠️ Consequences & Personal Legal Liability
Staff must understand the distinction between school-internal disciplinary systems and national criminal law. The school will not assume liability for individual actions.
Level 1: Minor Procedural Violations
Examples: Talking aggressively, ignoring non-injury parent reporting policies, mild verbal yelling.
Consequence: Official written warning, mandatory behavior correction counseling, kept permanently in personnel file.
Level 2: Major Policy Violations
Examples: Corporal punishment instances, repeated level-1 offenses, public shaming/bullying of a child.
Consequence: Immediate termination of employment, forfeiture of school benefits, complete refusal of any institutional recommendation.
Level 3: Severe Criminal Offenses
Examples: Any instance of sexual harassment/abuse, severe physical assault causing pain/injury, or systematic mental torture.
Consequence: Immediate termination + immediate police intervention. School will actively assist state prosecution of the teacher.
Explicit Legal Indemnity Declaration
"If any parents or governmental authorities initiate a civil, criminal, or constitutional case concerning physical, verbal, or sexual abuse, Regent Residential School maintains zero legal responsibility to defend, represent, or financially protect the accused staff member. The individual teacher/staff member is individually and criminally liable under the Muluki Criminal Code 2017. The school will fully align with and assist state authorities."
✍️ What Our Staff Legally Commits To (The 7-Point Contract)
Before stepping into our classrooms, every single employee must digitally sign and lock a legal contract of adherence. Here is exactly what they agree to under the provisions of Nepal Government Laws:
- I acknowledge that I have read, understood, and will abide by the Child Protection and Safeguarding Policy of Regent Residential School in its entirety.
- I recognize the authority of the Constitution of Nepal, Article 39 (Rights of the Child), and the Act Relating to Children, 2075, which declare any physical or mental abuse/torture against children a punishable criminal act.
- I agree to a strict, absolute Zero Tolerance Standard against any corporal punishment, physical escalation, verbal insults, emotional shaming, and any form of sexual misconduct/harassment.
- I explicitly acknowledge that the School will not represent, defend, or assume liability for my personal actions in any civil or criminal proceeding arising from physical, verbal, or sexual child abuse. Any prosecution will target my person individually by law.
- I accept that the School will actively support, report, and hand over my coordinates and case files to the Nepal Police and local authorities in the event of any level 3 (severe) child safeguarding violation.
- I commit to communicating with parents/guardians with absolute transparency, respect, and only through the designated, official administrative school applications.
- I accept that minor violations of the safeguarding policy will result in an official written warning, while major violations will lead to immediate employment termination, and severe violations will result in termination combined with police prosecution.
